Southern Grind Forestry Mulching — Terms and Conditions
Last updated: October 2, 2026
These Terms and Conditions govern use of https://www.southerngrindfl.com and, when expressly included in an accepted estimate or service agreement, services provided by Southern Grind Forestry Mulching ("Company," "we," "us," or "our"). "Customer" means the person or entity authorizing the work. "Website user" means anyone accessing our website.
1. Website Use and Service Agreements
You may use our website to learn about our services and request information or estimates. You must be at least 18 years old and authorized to enter into an agreement to book services. Submitting a quote request does not create a service agreement, reserve a work date, or guarantee pricing.
Before a job is accepted, we will provide an estimate or service agreement identifying the contracting business, customer, job location, scope, pricing basis, and applicable payment terms. These Terms apply to a job only when provided to the Customer and expressly accepted as part of that agreement. A project-specific written agreement controls if it conflicts with these Terms.
Where both parties agree to transact electronically, acceptance may be documented by electronic signature or another clear written electronic approval identifying the estimate and these Terms. We will retain the accepted version. Merely visiting the website does not authorize field work or constitute acceptance of a job agreement.
2. Services and Scope of Work
We provide forestry mulching, brush removal, fence-line clearing, trail creation, and other land management services expressly described in the accepted estimate, primarily in Jacksonville and Northeast Florida. Services are subject to site conditions, equipment capabilities, availability, and applicable requirements.
Only work described in the accepted estimate is included. Unless expressly listed, services do not include stump or root removal, excavation, grading, soil compaction, drainage installation, debris hauling, burning, herbicide application, surveying, or preparation of a construction-ready building pad. Forestry mulching alone does not certify a property as suitable for construction.
The Customer and Company will confirm the work area, vegetation to remove, vegetation to preserve, and access route before work begins. Additional acreage, widened trails, additional clearing, or other changes require written approval of the scope and any price or schedule adjustment before the additional work proceeds.
3. Estimates and Pricing
Estimates are based on available information about acreage, vegetation density and size, terrain, access, hazards, and the requested finish. Any expiration date, minimum charge, mobilization charge, deposit, or tax will be stated in the estimate where applicable.
The estimate will identify whether pricing is fixed, hourly, daily, or otherwise measured. A time-based estimate is an anticipated cost, rather than a guaranteed total, unless expressly stated otherwise. For time-based work, the estimate will identify billable time, minimums, and any spending limit. We will obtain approval before exceeding an agreed limit.
If concealed debris, unusually wet ground, inaccessible areas, or other material conditions change the work required, we may pause work and propose an adjustment. No revised charge is authorized solely because an unexpected condition exists. If the parties cannot agree, either may end the affected portion of the work, with payment due for authorized work already performed and previously agreed charges, subject to applicable law.
4. Property Ownership, Boundaries, and Permission
The Customer represents that they own the property or have authority from the owner to authorize the work and grant access. The Customer must accurately identify property boundaries, easements, rights-of-way, and areas excluded from clearing. We do not provide surveying services and will not knowingly work outside the authorized area.
If boundaries or permissions are uncertain, work in the affected area may be postponed until resolved. The Customer must identify protected vegetation and obtain necessary owner or association approvals. Responsibility for obtaining permits will be stated in the service agreement; required approvals must be secured before affected work begins. Nothing in these Terms authorizes either party to violate permitting, wetland, tree-protection, or other applicable requirements.
5. Utilities, Hidden Hazards, and Site Information
Before work begins, the Customer must disclose known wells, septic tanks and drain fields, irrigation, private utility lines, buried tanks, wire, fencing, concrete, metal, dumping areas, unstable ground, and other hazards. The Customer must identify private facilities and arrange appropriate private locating where needed; a public utility locate may not identify customer-owned facilities.
We will meet our own legally required utility notification, locating, and safe-work obligations when the work involves excavation or other covered activity. Customer disclosures do not replace those obligations. Neither party's responsibilities under applicable law are waived by these Terms.
If an unidentified hazard is discovered, we may stop affected work until it can be addressed safely. Any additional locating, removal, or remediation requires written agreement before additional charges are incurred. Responsibility for damage or expense will depend on the circumstances and applicable law, including each party's conduct; these Terms do not automatically make the Customer responsible for all hidden-hazard damage.
6. Access and Safety
The Customer must provide the agreed equipment and trailer access, disclose restrictions or weak crossings, and remove vehicles or other movable obstacles from the work area. Gates, bridges, driveways, and access routes must be suitable for the proposed equipment. We may decline or suspend use of a route we determine is unsafe.
People, pets, and livestock must remain outside the work area and equipment safety zone. The operator will determine the required separation based on equipment instructions and site conditions. Mulching equipment can throw debris; the Customer must not approach operating machinery and must help keep others away from the authorized work area.
We may pause work for unsafe conditions, unauthorized persons in the safety zone, suspected utility conflicts, or other immediate hazards. Any customer-caused standby or return-trip charge must have been disclosed and accepted in the service agreement.
7. Mulching Results and Ground Conditions
Forestry mulching processes vegetation into material generally left on the property. Mulch size, distribution, and depth vary with vegetation, terrain, and the agreed finish. Unless the estimate states otherwise, remaining roots, stumps, larger wood fragments, and uneven ground may be present. The finished area is not represented as barefoot-safe, lawn-ready, or free of all concealed objects.
Mulching does not guarantee permanent elimination of vegetation. Regrowth, including palmettos and invasive species, may occur and may require maintenance or separately agreed treatment. We do not guarantee a particular soil, drainage, erosion-control, or construction outcome unless expressly agreed in writing.
Tracked equipment may disturb soil or leave tracks, especially on soft or wet ground. We will use reasonable care and may postpone work to limit avoidable damage. Restoration of pre-existing defects or ordinary ground disturbance is included only if specified in the estimate. This provision does not excuse negligent operation or damage for which we are legally responsible.
8. Scheduling and Delays
Work dates and completion estimates are subject to weather, soil conditions, equipment availability, site access, required approvals, and safe operating conditions. We will communicate material delays and coordinate a revised schedule.
Neither party is responsible for delay caused by events beyond its reasonable control, provided it takes reasonable steps to reduce the delay and communicates with the other party. This does not eliminate payment obligations for completed work or refund obligations for unearned payments.
9. Deposits, Payments, and Cancellation
Deposit requirements, payment milestones, accepted payment methods, and invoice due dates will be stated in the accepted estimate or agreement. No deposit percentage, late fee, interest rate, or cancellation penalty is imposed by these Terms alone. Any such charge must be separately disclosed, agreed to, and lawful.
The Customer agrees to pay for authorized services under the accepted payment terms. We may suspend further work for overdue undisputed amounts after written notice and a reasonable opportunity to resolve the issue. The Customer should promptly identify disputed charges so the parties can address them.
Cancellation or rescheduling requests must be made as soon as possible using the contact method in the service agreement. Any cancellation charge or nonrefundable reservation amount must be expressly disclosed and agreed to before booking. Otherwise, unused deposits will be refunded after deducting charges for authorized work performed and any documented, nonrecoverable project expenses previously approved by the Customer, to the extent permitted by law.
If we cancel before work begins and no authorized work or approved project expenses have been incurred, we will refund the deposit. If work ends after it begins, we will provide an accounting of completed authorized work, approved expenses, payments, and any balance or refund due. Mandatory cancellation rights under applicable law remain unaffected.
10. Completion and Concerns
When practical, we will review completed work with the Customer or provide completion photos. Please report concerns promptly using the contact information in your estimate or invoice and give us a reasonable opportunity to inspect and address them. Any correction will be assessed against the agreed scope and applicable obligations.
A request for additional clearing or a different finish beyond the accepted scope is additional work requiring written approval. Payment or a failure to immediately report a concern does not waive rights that cannot lawfully be waived.
11. Photos and Marketing
We may take project photographs to document site conditions, progress, and completion. Marketing use of photographs or videos from the Customer's property requires separate permission. Agreeing to these Terms does not grant that permission. We will not publish the Customer's name, address, or other identifying information without separate authorization.
12. Website Content, Privacy, and Third-Party Links
Website information, sample pricing, photos, and descriptions are general information; the accepted service agreement defines the job's obligations. We aim to keep information accurate but cannot guarantee continuous availability or that all content is current or error-free. These website limitations do not disclaim our obligation to perform contracted field services with reasonable care.
Our original website text, branding, logos, and images, or content used with permission, may not be copied or used commercially without the relevant owner's permission, except as allowed by law. You may not use the website to submit fraudulent requests, interfere with operation, or attempt unauthorized access.
Third-party links and services are governed by their own terms and privacy practices. Any published Company Privacy Policy describes our handling of personal information; these Terms are not a substitute for a Privacy Policy. Information submitted for a quote may be used to respond and coordinate the requested services. A quote request does not by itself consent to unrelated marketing communications.
13. Responsibility and Liability
Each party remains responsible for its own actions and omissions as provided by applicable law. Nothing in these Terms releases the Company from responsibility for negligence, gross negligence, willful misconduct, or obligations that cannot lawfully be waived. These Terms do not impose a blanket release for bodily injury, utility damage, or property damage, or an automatic $100 liability cap on field services.
Any project-specific limitation of liability or allocation of risk must be stated separately in the service agreement, expressly accepted, and permitted by applicable law. Website availability statements do not limit responsibility for physical work performed on the property.
14. Florida Law and Disputes
Florida law governs these Terms and service agreements, subject to applicable federal law and mandatory protections. If a concern arises, the parties will first attempt in good faith to resolve it through direct communication, without preventing either party from seeking urgent relief or meeting a legal deadline. No mandatory arbitration agreement or waiver of jury trial is created by these Terms.
15. Changes and Severability
We may update these Terms by posting a revised version with an updated date. Changes will not retroactively modify an accepted project agreement; amendments to an existing job require the parties' agreement. If a provision is held unenforceable, the remaining provisions remain effective to the extent permitted by law. Failure to enforce a provision on one occasion does not waive enforcement on another.
